شادی شدہ آدمی گھر سے باہر کتنے دنوں تک رہ سکتا ہے

السلام علیکم ورحمتہ اللہ وبرکاتہ

کیا فرماتے ہیں علماے دین و مفتیان شرع متین مسئلۂ ذیل میں

سوال ۱ اگر کوئی شخص اپنی بیوی سے کم و بیش ڈیڑھ سال سے دور رہ رہا ہو تو اس کی بیوی کیا کرے؟

سوال ۲ایسے شوہر پر از روے شرع کیا حکم نافذ ہوتا؟

قرآن و حدیث کی روشنی میں جواب عنایت فرما کر عند اللہ ماجور و عند الناس مشکور ہوں

حدیث مصطفی صلی اللہ تعالی علیہ وسلم اور فقہاء کے بیانات و روایات سے واضح ہے اپنی بیوی کے حقوق زوجیت کو چار ماہ کی مدت کے اندر پورا کرنا ضروری ہے اگر چار ماہ سے زیادہ باہر رہا  ایسی صورت میں جب بیوی کو خاوند کی طرف رغبت ہو رہی ہو تو وہ آدمی ضرور گنہگار ہے لہذا وہ آدمی جو باہر ملازمت یا کمائی کرتا ہے وہ شخص کو چاہئے چار مہینے کے اندر اندر چھٹی لے کر گھر واپس جائیں اور جس کے پاس چار مہینے کے اندر واپس ہونے کا امکان نہیں ہے اور گھر سے بہت زیادہ دور ہو جہاں سے واپس سال یا دو سال میں ہوتا ہو چار ماہ کے اندر واپس ہونا بہت مشکل ہو تو ایسی صورتوں میں درجہ ذیل صورت جائز ہے اس شرط کے ساتھ کہ 

اول1 بیوی کو  حقوق زوجیت  (جماع وغیرہ ) کی طرف زیادہ شوق و رغبت نہ ہو

دوم2 بیوی کی  اجازت  ہو۔

سوم3  بیوی  کے فتنے میں پڑنے کا اندیشہ بھی نہ ہو 

چہارم4 اولاد کی تعلیم اور تربیت کے ضائع ہونے کا اندیشہ بھی نہ ہو

جیسا کہ حضور اعلی حضرت عظیم البرکت تحریر فرماتے ہیں

بلا ضرورت سفر میں زیادہ رہناکسی کونہ چاہئے،حدیث میں حکم فرمایا ہے کہ جب کام ہوچکے سفر سے جلد واپس آؤ اور جووطن میں زوجہ چھوڑ آیا ہو اسے حکم ہے کہ جہاں تك بن پڑے چار ماہ کے اندر اندر واپس آئے بذٰلك امر امیر المومنین الفاروق الاعظم علیہ الرضوان(مومنوں کے حکمران،حق اور باطل میں سب سے بڑے فرق کرنے والے حضرت عمر نے مسلمانوں کو یہی حکم فرمایا تھا انھیں الله تعالٰی کی خوشنودی حاصل ہو

How long can a married man stay out of the house?

In the name of God, Most Gracious, Most Merciful

 Seek help from Allah said Barakatuh

 What do the religious scholars and muftis say about the following issue?

 Question: If a man has been living away from his wife for more or less a year and a half, what should his wife do?

 Question: What is the ruling on such a husband according to sharee'ah?

 I am grateful to Allah and to the people for giving me an answer in the light of Qur'an and Hadith

 The answer is with Al-Mulk Al-Wahab

 The hadeeth is clear from the narrations and traditions of Mustafa (peace and blessings of Allaah be upon him) and the jurists. It is necessary to fulfill the marital rights of the wife within a period of four months, if she stays out for more than four months.  If so, the man is definitely a sinner, so the man who works or earns outside should take leave within four months and return home, and he who is unlikely to return within four months and leave home.  If it is very far from where the return takes place in a year or two, it is very difficult to return within four months, then in such cases the following case is permissible provided that

First, the wife should not be too interested in marital rights (intercourse, etc.)

 Secondly, permission of 2 wives.

 Thirdly, do not be afraid of falling into the temptation of your wife

 Fourthly, there should be no fear of losing the education and training of 4 children

 As Hazrat Azeemul -Barakat writes

There is no need to stay in the journey unnecessarily. The hadeeth says that when the work is done, you should return from the journey as soon as possible.  This is what Hazrat Umar (may Allah be pleased with him), the ruler of the believers, who made the biggest difference between truth and falsehood, commanded the Muslims to have the pleasure of Allah Almighty.
